These Candidate Terms of Service (the "Terms") govern two connected services: recruitment and employment-intermediation services provided by XCITERR LTD. (the "Recruitment Operator") and Betihuti technology and mobile-app services supplied and temporarily published by AUTOMAIZE SOLUTIONS LTD (the "Technology Publisher"). Each company is a party only for the obligations allocated to it in these Terms.

By creating an account or otherwise using the Service, you confirm that you accept these Terms. If you do not accept them, you must not use the Service.

1.Definitions and interpretation

  1. 1.1"Interview" means a structured artificial-intelligence interview conducted through the Service; "Scorecard" means the assessment generated from an Interview; and "Customer" means an employer using the Service to assess candidates.
  2. 1.2References to the Recruitment Operator mean Xciterr; references to the Technology Publisher mean Automaize. References to "we" mean the company responsible for the relevant obligation and do not make either company responsible for the other's independent acts.
  3. 1.3Headings are for convenience only and do not affect interpretation. Words importing the singular include the plural and vice versa.

2.Platform role, matching and employers

  1. 2.1When recruitment operations are authorised and enabled, Xciterr will provide the online employment-intermediation service. Automaize provides the software, account, security and app-publication layer. Neither company is your employer, and neither guarantees an interview, offer, employment relationship or any particular ranking or outcome.
  2. 2.2Recommendations and rankings use job-related information such as your stated preferences, skills, experience, application evidence and role criteria. Automated scorecards are decision support; the relevant employer remains responsible for its vacancy and hiring decision.
  3. 2.3Xciterr is responsible for agency-led job publication, candidate introductions and recruitment communications. Employer users remain responsible for the accuracy and lawfulness of the vacancy information they supply. Xciterr and Automaize take measures within their respective roles to moderate unlawful or misleading content but do not guarantee every employer, salary statement or workplace condition.
  4. 2.4Recruitment services are not yet live. App review, test distribution, account creation or app availability in a store does not mean that Xciterr is offering recruitment intermediation. Applications, candidate introductions and live employer recruitment workflows will be enabled only after the required licence or written territorial authority has been verified.

3.Eligibility

  1. 3.1You must be at or above the minimum working age applicable in your jurisdiction and have the legal capacity to enter into these Terms.
  2. 3.2You must provide accurate and complete information when registering and keep it up to date.

4.Accounts and security

  1. 4.1You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  2. 4.2You must not share your account, impersonate any person, or create an account on behalf of another person without authority.
  3. 4.3You must notify us promptly of any unauthorised use of your account.

5.The Interview and fair use

  1. 5.1You must complete each Interview personally and must not permit any other person or tool to answer on your behalf.
  2. 5.2You may take one Interview per role family unless we offer you a further opportunity.
  3. 5.3You must not attempt to manipulate, record, reproduce or distribute Interview questions or to otherwise undermine the integrity of the assessment.

6.Your content and consent

  1. 6.1You retain all rights in the content you provide. You grant Xciterr and Automaize a non-exclusive licence to process that content only as necessary for their respective recruitment and technology obligations under these Terms and the Privacy Notice.
  2. 6.2When you apply, you instruct Xciterr to introduce you to the selected Customer and instruct Automaize to transmit the selected profile and Interview evidence. The Customer then processes that copy as an independent controller under its own privacy notice. Withdrawing an optional sharing preference stops future platform sharing but does not automatically erase data a Customer must lawfully retain; you may exercise your rights with the Customer, Xciterr and Automaize.

7.Acceptable use

  1. 7.1You must not use the Service unlawfully, infringe the rights of others, or upload unlawful, harmful or misleading content.
  2. 7.2You must not attempt to gain unauthorised access to, interfere with, scrape or disrupt the Service or its underlying systems.

8.Content moderation, notices and appeals

  1. 8.1You may report an allegedly illegal job listing, message or other item through support, at legal@betihuti.com, or to Xciterr at info@xciterr.com, identifying its exact location and why you consider it illegal. Knowingly unfounded notices may themselves breach these Terms.
  2. 8.2We may remove or restrict illegal or Terms-violating content, suspend abusive accounts, preserve evidence and notify competent authorities where required. We will provide reasons and a practical appeal route where required by the Digital Services Act or other applicable law.

9.Availability and changes to the Service

  1. 9.1We aim to keep the Service available and accurate but provide it on an "as is" and "as available" basis.
  2. 9.2We may add, modify or discontinue features, and will give reasonable notice of material changes where practicable.

10.Intellectual property

  1. 10.1The Betihuti software, design and technology are owned by Automaize or its licensors. Recruitment content may be owned or licensed by Xciterr, the applicable employer or another identified rights holder. You receive only the limited right to use the Service under these Terms.

11.Disclaimers

  1. 11.1To the fullest extent permitted by law, we exclude all implied warranties in relation to the Service. A Scorecard is decision support and does not guarantee any particular hiring outcome.

12.Limitation of liability

  1. 12.1Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, gross negligence or wilful misconduct, or any liability or consumer remedy that applicable law does not permit us to limit.
  2. 12.2Subject to the foregoing and to the extent permitted by mandatory law, we are not liable for unforeseeable or indirect business losses. This does not exclude liability for failure to supply a digital service in conformity with mandatory consumer law or for loss caused by our failure to use reasonable care and skill.
  3. 12.3Xciterr is responsible for its recruitment and employment-intermediation acts. Automaize is responsible for the technology, account, security and app-publication obligations allocated to it. Neither company excludes liability for its own acts where applicable law prohibits that exclusion.

13.Consumer withdrawal and digital-service rights

  1. 13.1The candidate Service is supplied without a monetary charge, although personal data is processed as described in the Privacy Notice. If mandatory consumer law applies, you may withdraw from this distance contract within 14 days of account creation by using the public account-deletion/withdrawal function or contacting support. We will stop the Service and erase data subject to lawful retention and legal holds.
  2. 13.2You may request that access begin immediately during the withdrawal period. This does not remove any mandatory withdrawal right except to the extent and under the conditions expressly permitted by law.
  3. 13.3You retain mandatory rights to a digital service that conforms to the contract, including applicable rights to have a lack of conformity remedied, receive any legally available reduction, or terminate the contract. These Terms do not restrict those rights.

14.Term and termination

  1. 14.1These Terms apply for as long as you use the Service. You may close your account and request deletion of your data at any time.
  2. 14.2We may suspend or terminate your access where you materially breach these Terms, create a security or legal risk, or where required by law. Except where prohibited or urgent action is necessary, we will explain the material grounds and provide a way to contest the decision.

15.Governing law and jurisdiction

  1. 15.1The recruitment and employment-intermediation provisions are governed by the laws of the Republic of Bulgaria. The technology and app-publication provisions are governed by the laws of the Republic of Cyprus.
  2. 15.2You may bring a claim against the responsible company in the courts having jurisdiction under applicable law. If you are a consumer resident in another EEA country, these choices do not deprive you of mandatory protections or the right to bring proceedings in the courts available to you under consumer and private-international-law rules.

16.Changes to these Terms and contact

  1. 16.1We may amend these Terms from time to time and will notify you of material changes before they take effect.
  2. 16.2Technology, account and app questions may be addressed to legal@betihuti.com. Recruitment and agency questions may be addressed to info@xciterr.com.
